Drunkenness.—Henry Malono alias Beeves was punished in the usual manner for this offence.

Larceny.—Daniel McTuaney and Thos.' Mclnaney were charged with stealing a quantity of firewood from Tairua, the property of Francis Daykin.—Prisoners pleaded not guilty.—Sergeant Jackson conducted, tho prosecution. — Franois Daykin deposed that ho resided at Shortland. Ho owned a large pile of firewood on the Golden Arrow G.M. Oo's. property, Tairua. There was no other firewood there but his. About three months ago he gave the prisoners permission to live in a house on tho ground. Neither prisoners or anyone else had authority to take the firewood, which he valued at under five pounds. The wood was not stacked, but was lying in a heap,—Eobert Hale deposed that he resided at Tairua, about five minutes walk from tho firewood heap. Ho saw the prisoners take a truck to where tho firewood was heaped, and fill it, and then take it down the tramway. There was about a ton and a half of firewood taken away by tho prisoners. He had authority from Daykin to mind the battery and other property. —By one of the prisoners: He could not swear that Daniel Mclnaney took the wood, as there was a third brother who looked very like him; although he had no doubt that it was Daniel, the elder prisoner.—He was positive that Thomas, the younger prisoner, was one of those that took the wood,—Constable Gordon deposed that he arrested the prisoner at their house at Tairua. Daniel Mclnaney admitted to witness that he had taken a few sticks of wood to light the fire with.
