WARDEN'S COURT.-Yesterday.
(Before W, Fbasbe, Esq, AYimlen.) Alleged ENCEoAcniiENT.-The plaint was laid by John Laphani, Alfred Aylotfc, William Towers, and Edward Pearson, against Eobcrt Wingatc, John Wilcox, Henry Wilcox, William McDuff, and the Black Angel G.M.C., and set forth that tho plaintiffs, as tributcrs to the Alburnia G.M.C., were under the provisions of tho Gold Miniug Districts Act, 1873, in possession of a piece of land for gold mining purposes, being part of the license of tho Alburnia Company. That the defendants in the months of July and August wrongfully encroached, broko, and entered upon tho said land, and took therefrom certain quartz ore and gold, wheroforo the complainants claimed that the defendants bo adjudged to have encroached, broko, and entered as aforesaid, and that tho Court ascertain tho damage sustained by the complainants in tho premises, and that tho Court givo to the complainants such relief as it may think lit in tho premises.—Mr Macdonald for the plaintiffs, and Mr Brassey for the defen. dants.-Mr Macdonald said that in this case he would ask the Court to strike out tho case and fix thocosts. Circumstances had arisen which prevented him from proceeding, but the same case would bo brought on again. As notice of withdrawal was only served yesterday, ho had no doubt the other side had made all preparations to defend it; but as the case would be brought on again, he undertook, to say that the same preparation would do again. It was only now for the Court to fix tho costs.—The costs wero by consent fixed at £o 55.; and on Mr Macdonald undertaking that this would be paid, ho was allowed to withdraw tho case. „„
