Folisv and Otukks,—Theao eases woro called on pro forma.-Mr Brassey, for plaintifls, said tlmt au nrrnngement had been mndo between tho parties, and Iho ctiscs would therefore bo withdra.m Mr Mucdonald acquiesced on behalf of the defendants.— Tho following is a copy of tho agreement mado between tlio parties, which was drawn up by tho Warden aud sigiicd by tho representatives on tho ground at Waitekauri, and subsequently couutorsigned by counsel in Mackaytown " Waitekauri, ICt'i July, 1875.—Archibald Clark for tho Queen of Beauty claim, and Patrick Foley, for tho Golden Point shareholders, agrco as followsTho two plaints laid by Clark to bo, withdrawn at such time or to bo proceeded with as Patrick Foley, for tho Golden Point shareholders, may direct. Foley's party to pay to Clark's party tho sum of £30 .to cover all expenses of surveys, solicitors, and costs in tho matter. Tho surveys to,become tho property of Foloy and party. Foley and parly to agrco to lot tho Queen of Beauty peoplo continuo tho I drive into tho Golden Point Amalgamated ground, Clark and party being obliged to stack at mouth of drivo any quartz out, aud tlioy will bo allowed (should they choose) to put in a lower level, provided tho samo is commenced within thrco months from this date, and in doing so all quartz cut in tho Golden Point Amalgamated to bo stacked for tlio owners—these drives into tho Golden Point Amalgamated being merely ollowed to traco tho course of reef, and to allow tho Queen of Boauty shareholders to prospect their own ground through tho Golden Point to savo cxponso. Tho Queen of Beauty shareholders, wishing further to facilitate tho , formation of tho proposed Waitekauri Company in tho erection of machinery, agree to withdraw their objection to the water rights applied for by Mr Bleaz'ard, provided that tlio same, when granted,-bo for tlio Waitokauri Company. Clark and party, bolieving they should have sufficient water to drive tho proposed'lo head of stampers, somo arrangement being made by tho Warden for facilitating tho tcstiug of other claims' quarlz than those in company. If it is thought best by Foley and ; party's solicitors to go on villi tho cases, Clark agrees to proceed and tako judgment, and to transfer tho ground to suoli person as Foley and party may direct, at Foloy aud parly's cxpeiiso.—A.
