APPLICATION FOR VARIATION. In the Supreme Court on Saturday afternoon application was made by Mary Ann jjowus (Mr. G. H. Weston) under tlio “Family Protection Act' 1 for an order varying the terms of the will of the late John Downs, Mr. R. 11. Quiluam appearing on behalf of the trustees of the estate. He also stated that he was instructed by the residuary legatees under the will (the Now Plymouth Rorough Council) to state they offered no objection to the proceedings, and would submit to the order of the court. Mr. Weston stated that plaintiff had the full occupancy of a dwelling-house during her widowhood 1 and an annuity of £p2 per year. All the outgoings on tho estate were a charge upon the trustees. . The applicant asked that the annuity should bo increased to £l2O per year. This would mean encroaching upon tho principal of the estate, but it was felt that the first charge was the maintenance of the testator’s widow, notwithstanding the fact that tho residuary Itgatces were tho Borough Council and the bequest ’was a public charity. Mr. Quilliam said that the trustees and the residuary legatees were fully cognisant of all tho circumstances, and offered no objection to the application. His Honour said ho would ta’ko time to consider his decision.
