SYDNEY GOVERNMENT ROUSE.

JUDGMENT OF THE COURT. GIVEN AGAINST THE MINISTRY. By Electric Telegraph.—Copyright. SYDNEY, March 20: The specially-constituted equity tribunal delivered its reserved judgment in connection with the alleged eviction of the Governor-General. The court ■ found that tho Government of New South Wales was merely tlio custodian of Government House for tho Imperial authorities and was not entitled :to utilise the premises for other than the purposes for which it was originally sot apart. .An injunction was granted, : : with costs against. the Government. Having regard to the relation of tho Governor to tho Crown, both as the executive head of the Empire am}-' of New South Wales, tho court, was of opinion that a proprietary right 'in lands set apart before the passing of tho constitution .statute fur the purpose of a Governor’s residence did hot, i; any more than lands set apart for naval: A: and military purposes, pass from the b Imperial Government to.the New South' Wales Government. Moreover, though the laud might have been dispropriated from the purpose of a Governor’s residence and applied to a purely local purpose by an executive Act,' without ’legislation, -this -could not be done by? the Governor acting on the sole advice A :: of his local Ministers, much less by the,,y. Ministers themselves without his Coil- j: currence. By whatever means such a change of proprietary. right taught Jje.'gi. effected there should be some evidence ■ of concurrence by the Imperial Government. The Cabinet will consider, tho court’s 4 decision with regard to Government, House on Tuesday. Meantime it i will v obtain legal opinion as to- whether there are any grounds of appeal to tho Privy Council. Should an appeal not He Mr.' ; Carmichael has indicated that the'house v will probably bo used again as a reei# ence for the State Governor.
