WAITARA S.M. COURT.

(From our own* Correspondent.) The fortnightly sitting of the Waitara Magistrate's Court was held on "Wednesday morning before Mr. Fitzherbert, S.M. The following undefended cases were disposed of by default: — W. A. O'Donnell v. A. J. Schiemey, £2 Ss (30s) ; Hvuth Purdie v. Punga, £6 5s (20s); Jenkins, Matthews and Pigott v . W. J. Thomason, £28 lfe (545); Joe West v. Tawhanga Butler, £3 5s (20s) ; Nosworthy Bros. v. John Nally, £1 17s (and costs). Defended cases: — Soth Green v. W. , J. Parsons, claim £25, being £15 for ' goods belonging to plaintiff held by defendant, and £10 .damages for detention. Aftor hearing the evidence and 'legal arguments, the said theit while Parsons rnigbt have a good claim for breach of aiiroomont, the only point to be considered was that referring to tho detention' of the goodsi*' There was no doubt that these I were detained, and judgment woxild be I ;.jiven for £15, to be reduced to Is on goods' being given up. Wilson, claim £4 9s for preparing lease of Harboxir Board section at auction, tho deeds^ for tjie same bein^ prepared Hjy plaintiff at defendant's roauost." Defendant ontcrcd into possession, and had paid the first half-year's rent, but on Foby-uary 22 he camo to witness's office, objecting to the condition that the improvements- should be insured in the name of the board. The defendant in his evidence denied having instructed plaiutiff, and he further said that- he told the chairman of tho Harboiir Board that he was not going on the place.
