MOTION DISMISSED. Information was received from Wel'ington this morning that the motion for i writ of certiorari in the matter of granting a license to the Hotel Coiri•nonwealth at New Plymouth had been iismissed. Argument ever the motion was henrd at the last Supreme Court sittings here before His Honor Justice E. T. Conolly, who then ressrved his de•i«son. His Honor in dismissing the motion held there lad been no bias on the part of the Licencing Magistrate in granting the license ;. and that the second ground that the Magistrate had borrowed money on insufficient security from a party in.terested in obtaining the license, was false nnd malicious. The Judge held alao that the application for the motion was uncalled for and seemed actuated by malice, as there was no ground for bias. Costs : amounting to £50 followed the judgment Proceedings were stayed for one month. (Per Press Association), Wellington, October 26. — Judge Connolly gave judgment to-day on tht motion argued at New Plymouth for the remand into the Supreme Court of the application for the license for Hotel Commonwealth. His Honor in reviewing the case expressed surprise that the Minister of Justice, should have treated seriously the anonymous letters making insinuations against the magistrate (Mt Stanford), instead of consigning the let- H ter to the waste paper basket. Ftwas plain that Mr Stanford had no interest in the matter as inuauated. The present application wag quite uncalled | o; an,! bore strong indication of being actuated by malice. The motion was dismissed with £60 costs. Execution was stayed for a month to enable the losing side to consider whether to appeal.
