TO THE EDITOR. SIR, - 1 read in your laft week* issue a law case, Carrington Road v H. Rutden, an employee of Mr W. J. Russell, who was charged -with driving a dray with tyres less than three inches wide, and carrying a load of more than 12 cwtH. Tho magistrate, in givirJg judgment, Bnid that assuming the by-laws were in proper fo-m, there were two questions that would' have to be proved to constitute theoffenco, the first question being— was tba tyro of the dray less than three inches?" and the second, was the dray loaded with more than 12 cwts ? There was no doubt that the evidence showed the tyre was less than 3 inches. Question, was that au offence ? again, in the opinion of the court, the evidence did sot show that the dray bad 12 cwts on board. Question, was the dray, with tyres less than three .inches, allowed on the road ? the by-laws say "no person shall use any metalled or gravelled road within the CarringtoD-road district, County of Taranaki, by the traction thereon of any vehicle or thing; save and except tuch vehicles as are mentioned and specified in the first column of schedule Bof this bye-law." According to thiß it was not lawful for the dray I with less than three inch tyres to bo on the road.
