JN Re WILLIAM BARNARD, BUTCHER. William Barnard, being sworn, said : I arrived in New Plymouth from Christ church about June, 1883. I bought Bishop's butcher's business. My brother-in-law, David Edgington, was in partnership with me at that time. Wo had between £500 and £600 at that time. My brother in-law continued in partnership for about 18 months. I paid him about £100 for his share when he left. I cannot say tho exact sum, as I did not keep a cash book. I never kept a cash book at any time. I have no other books of accounts except what I h&ve given to the D.O.A. I have not had a bank account since March, 1890, I Bhall look for the former bank books Rnd give them to the Assignee. I sold my butcher's business to Mr W. Bayly in February, 1889, for £102 19s 6d. Thia money was paid to Mr N King on my account. I sold tin's business because it had not been a paying one for about two years boforo that. I attribute my present position to losses in the butcher's business and in horse racing. 1 cannot give particulars as I did not keep any books, nnd from the injuries I received on my head about 18 months ago I am unable to concentrate my thoughts to think out particulars. I have no property except what is montioned in my sche lule. By property I moan that I havo no assets outside the book debts I have seenacaount rendered by Mr Cunningham; I believe it is correct but I cannot say for certain that it is so During the two years July, 1888, to Sep tembor, 1890, all the money I received, except what I paid for current expenses, passed through Mr N. King, as shown by his statement of accounts which I now produce. This statement shows I was in his debt to the amount of £393 3s 10J. I paid this by £150 I received from my wife, who raised the money by mortgaging her house in Morley-street, and by £90 recoived from Jamea Hooker and £200 I borrowod from Mr Drake on a bill of sale over all I had. After settling with Mr King I had nothing left, and carried on horso racing by money advanced in tho first instance by James Hooker and afterwards by Mr Cunningham. Have read the account rendered by James Hooker ; it soems to be correct, but ho ought to givo mo c odit for half tha winnings less expenses ol tho horse Tattler, and the half of' the price for which ho was sold. The receipt produced by J. Hooker for £50 for Tattler, dated December 1, 1890, is a bogus receipt, es he did not pay me tho JL'SO or any part of it. The object of my giving the receipt was that it might be produced in the event of any protest being lodged for improper nominations. Tho receipt was given before Hooker lent mo any money. I bought Tuttler from Gus Sole for £40 It was paid for by the proceeds of a joint promissory note at 3 months by Hooker and myself, and discounted by Mr Curtisl think Before tho bill became due tho horse won a race at Ttjrakina races of £55, with which we met tho promissory note and divide i tho surplus Ho also ought to givo me credit for the amount received from Mr J.C. Georgo for the goodwill of tho leaso of tho farm at Warea, which, lam told by Mr George, was £15, and aleo the balance received from the sale of tho br.celet to tho Taranaki Jockey Club. I was unable to pay any interest to Mr Druke, and he sold the hordes included in the bill of sale by auction, ami they brought very low prices ; the mare Jenny soiling for eighty fguincas, and she was good vaule for £200 ; tha horse Jerome only realised £24, ami ho coat mo fully £100, and tho othor two wero also sold ut a loss.
