Wellington, April 8. —Mr Graham, CM., dismissed the charge of murdering Jacobsen against Smith, on the ground that the evidence waa not strong enough to send tho case before a jury. In the larceny case no evidence was offered, and the prisoner was discharged.

Jn view of this the Board have decided to enter a prosecution against any person taking a<vay bones from the stack.
