TO THE EDITOR. Sir, — In a recent issue your Stratford resident agent says: "There is a report about that Mr Barloyman has abandoned his action against the County Council." As this is likely to produce the erroneous impression that I admit tho claim which I .have sot up to be groundless, I will ask your permission to say this is not the case. The County Council in tlwir defence have denied that they committed the trespass, but I am informed that the County Solicitor has advised the Council that the bed of tho river is my freehold property; advice in accordance with the rules laid down in the leading English and Scotch cases upon the question, and which have been held to apply to the Colonies, and by a ruling of tho New Zealand Court of Appeal to apply to New Zealand. Having got my title ■admitted, I have gained the object sought; but the effect of tho defence set up by the County Council will be to leave the contractors, who actually committed the* trespass at the instigation of the Chairman of the County Council,* to get out of the difficulty the bost way they can. — I am, &c, J,.
