Judge Kenny.

Judgment for Plaintiff.— R. Parris v. James Batten. Mr. Halse for plaintiff. Defendant was ordered to pay forthwith £(37 Is., and costs £2 lls., or to bo imprisoned, on application of the plaintiff, for two calendar months.

Action for False Representation. — Peter Jaok v. Robert Snell. Mr. Halse for plaintiff, and Mr. Hammerton for defendant. Plaintiff alleged that defendant had iuduced him to purchase for £125 the right to collect the entrance fees to the race-course at the last Anniversary Ilaces, according to 11 scale which defendant knew, by tho terms of his lease from the Superintendent, was excessive, and as to the charge of Gd. for foot passengers unlawful, and that he (the plaintiff) was not aware until afterwards that such charges were unauthorised. The plaintiff claimed £30 15a. (id., his net receipts having been short of the £125 paid by that amount, after allowing for uecesaary expenses. The main defeuce wns, that the plaintiff wa? made aware of the contents of the lease before he purchased the right in question, but, as the defendant failed in proving this to the satisfaction of the Court, judgment was given for the plaintiff for £30 15s. fid., with costs £4 11s.
