Sir — As I have been frequently asked by porsons in this place — " What document is it that you hold from the Home Government that givos you such a claim to Waitara land," and as I have never yet satisfied these quorists on this point, I havo no objeotion to do so throngh the medium of your valuable journal, provided you think it a matter of sufficient interest to the public. — I. am, &c. Extracts from official documents above reforred. to, addressed to the Proprietors of New Zealand Company's Land Orders resident in England, and' dated 29Mi December, 1851, hefnre the Crown gave over its liabilities to tJie Now Zealand Government : — "^ Her Majesty's Government have had under their consideration the" system horetoforo observed by the New Zealand Company in respect to tho registration and certifying of transfers of land orders in the several settlements of the Company in New Zealand, &o. * * * " Her Majesty's Government havo been advised by the Law Officers of the Crown, that it is not incumbent on the Crown, under tho Act 10 & 11 Vie. c. .112, to follow tho practice of the Company in this respect, although the Crown is bound to fulfil the contracts of the Company, aud, in the case of a holder of a*n instrument of transfer, to convey tho land described to him. Her Majesty's Government do not propose under these circumstances, to grant any farther certificates of transfers, or to establish any registry of thorn in this country as was done by tho New Zealand Corupauy, but are anxious that land orders should, as early as possible, bo exchanged for Crown grants of the land to which they refer. Such Crown grants, however, can only bo issued in the Colony, and on the application to tho local Government of the holders of land orders or certificates of selection, or their duly authorised attornies," &c. Note. — On my arrival in New Plymouth from England, in July, 1857, I found that an Act (the " Land Ordera and Scrip Act, 1856 ") had been passed by the New Zealand Legislature, which, if it could have been acted upon, would havo completely subverted tho Act of Parliament and good faith of the abovo letter, under which security I had risked the bringing of my family to NewZealaud, and accepted power from the Court of Chancery and other parties to manage thoir estates in this Colony. I therefore remonstrated with tho New Zealand Government on the matter. I saw them personally, and finallj^after interchange of opinions, and with a desire to avoid troubling the .Home Government, I wroto to them, 2nd August, 1858, a proposibion whioh thoy agreed to. Hence the 37J acres of suburban land or 75 acres of rural land for each 50-acre New Zealand Company's Land Order on tho conditions containod in clause 8 of the " Land Orders and Scrip Act, 1858," which the Now Zealand Government have declined to carry out.
