On reaching the Washdyke Miss Malthus determined to go from there to the Point by train, and avoid part of the cold drive. Defendant had two glasses of beer in town during the day, and one glass of whisky. At the Washdyke he had another glass of whisky, and then drove towards the Point alone. A Point resident named Shepherd, riding home, overtook him just beyond the Levels, and defendant was then sitting on the axle of the buggy, jammed between the body and the wheel, with his face resting on the wheel, and oue arm through the spokes. The seat was capsized, and lay across the wheel, and Shepherd picked up a lamp and defendant's hat a little way back on the road. Another person helped him to lift defendant out, and just then a neighbour of defendant's named Matthews drove up. Defendant seemed dazed, and limp and helpless, and Matthews drove him home. On the way home he recovered, and said he went to sleep in the buggy, and did not know how the accident happened, being dazed by a blow in the face.
