MAGISTRATE REFUSES ORDER. ELTHAM FAMILY’S TROUBLE. Reserved judgment was given by Mr. W. H. Woodward, S.M., at the Eltham court yesterday in the case in which Rose Furey (Mr. P. J. Coleman) made complaint against Daniel Joseph Furey (Mr. R. R. Tyrer) for an order for separation, maintenance and guardianship. The magistrate heard the evidence at a previous sitting and declined to make an order against Furey. “The circumstances seem to me to bear out his contention that his wife wants his money and his room,” said the magistrate in his judgment. “This shows that complainant was not prepared to give living together a fair trial. The subsequent events up to the time of defendant finally leaving give the same impression. Defendant wanted his wife to get rid of the boarders but she could not make this concession to him. The squabbles during this period were not accompanied by any cruel violence on his part and were by no means always his fault. I am. not satisfied that he drinks so Heavily as to make it unreasonable that complainant should live with him. I make no order.” Costs of £2 2s were allowed Furey.
