APPEAL DISMISSED
COURT OF APPEAL RULING.

Wellington, April 15.
The Court of Appeal this morning delivered judgment in the case the King v. Child on March 15. The judgment of the Court was delivered by Mr. Jus- . tice Reed, who held: First, that a telephone box was a public place within the meaning of Section 52 .(sub-section J) of the Police Offences Act, 1927; secondly, that it was open to a jury upon evidence of accused’s actions as disclosed at the trial to find him guilty of "frequenting”; thirdly, that the evidence of police officers as to accused’s previous convictions was properly admitted. Ac-, cused’s appeal was accordingly, dismissed.
