RESERVED JUDGMENT
ALTERATIONS OF TWO WILLS.
FAMILY PROTECTION ACT. Two reserved judgments upon applications under the Family Protection Act, 1908, were delivered by Mr. Justice Smith at New Plymouth yesterday. In the case in which Gladys May Baker sought greater provision from the estate of her father, George Miles, farmer, Inglewood, an order was made by which the legacy of £225 was increased by £75 from the residuary estate other than farm property. No allowance for costs was made to Charles Edward Miles, but other- costs were to be paid out of the residuary estate other than farm property. On the application of Gwendoline Rose Paul seeking a variation of the provisions of the will of her deceased husband, Ronald Cassells Paul, judgment was also given.
Upon plaintiff giving to the trustees of the will of the testator a registerable mortgage over her two properties at Auckland, the following provisions shall take effect: (1) The trustees shall hold £lOO on trust to aid in payment of the debts of the widow at the date of tes-
tator’s death. (2) Until the testator’s son, Sydney James Maurice Paul, attains the age of 21, or dies before attaining that age, or until the death or re-marriage of the testator’s widow, the trustees shall hold such sum of money as will be required to increase the widow’s income from the residuary estate to £4 10s a week, provided the widow maintains and educates the son during his minority. (3) Upon the son reaching tire age of 21, or dying previously, the income of the widow shall be maintained at £3 a week until her death or re-marriage.
Costs are to be paid from the residuary estate.
