DAIRY REGULATIONS.
The finding of the Court of Appeal in regard to the new dairy regulation forbidding the transfer of supply from one factory to another during the currency of any export season will cause some serious thought among the authorities and those in control of the dairy industry. The judgment of the Court emphasises once again the undesirability of “legislation by regulation” to which individual judges have referred in terms of disparagement from time to time, particularly when a regulation has interfered with individual liberty of action. Judges have held that action in that direction should be taken only after full consideration and with the support of Parliament as definite proof that public opinion is behind such curtailment. The Appeal Court appears to have maintained that view, and, judging from the remarks of the Solicitor-General in the case now decided, the Government has had this aspect of the regulation now declared void brought under its consideration. The Solicitor-General stated
that if the regulation were declared void the Government would introduce legislation to achieve the results it was hoped the regulation would bring about. There is no doubt that to a large portion of the dairy industry the prevention of the transfer of supply is one of the bulwarks of the new system of grading milk and cream, and if that protection is removed the attitude towards that system must alter.' Those in favour of the regulation claim that it has the support of the majority of the people engaged in the dairy industry. If they can convince the Government and Parliament that their claim is sound there should be little difficulty in obtaining legislative sanction for what is considered best for the industry as a whole.
