CLAIM BY THREE CHILDREN. ALLEGATION OF NEGLIGENCE. By Telegraph—Press Association. Wellington, Last Night. Further litigation arising out of a co!-> lision between two motor-cars at the corner of Witako Street and Waterloo Road, Lower Hutt, last Labour Day is taking place in the Supreme Court. The cars were driven by Eddie Geor.-e Shearer, a draper of Lower I'utt, and James Russell, a grocer. A passenger in Russell’s car was recently awarded damages for injuries she received in the- collision. Three children in Shearer's car are claiming a total of £2380 2s 6d damages from Russell, alleging that the injuries they received were due to the negligence of Russell. The defence is a , denial of any negligence, it being contended that the collision was due .to the negligence of Shearer. The plaintiffs are Eunice Goss, Patricia Goss and William Goss, who are suing through their guardians ad litem, Robert Howard-Taylor and Frederick Goss, a bus driver of Lower Hutt. Eunice Goss claims £lOO, Patricia £2OOO, William Goss £2OO general damages and Frederick Goss £BO 2s 6d special damages.

The Chief Justice, Sir Michael Myers, and a special jury of twelve are hearing the action.
