‘UNRESERVEDLY WITHDRAWN’
ALLEGED MISREPRESENTATION. *. AN ACTION STRUCK OUT. Arising out of the sale and purchase of .a small dairy farm, at Bell Block, of which possession was given on June 12, 1932, Mrs. Ruby Winifred Watson brought an action in the Supreme Court at New Plymouth yesterday for' a recission of the contract with the vendor, Robert Atchi- ’ bald Shewry, Tahdra. The parties had been brought together by E. Jackson, land agent. The grounds of the application for recission were misrepresentation in respect to carrying capacity, etc., and damages were claimed for alleged breach of warranty and fraudulent misrepresentation. However, after the husband of the plaintiff had given evidence concerning his part in the negotiations and had been crossexamined, the parties conferred, J® later it was announced the action., naa been amicably settled. As a consequence it was struck out. . “All allegations whatever of misrepresentation and fraud are unreservedly withdrawn,” said counsel for the plain- ' Mr. R. H.
