SETTLEMENT OF WILL CASE

allegations withdrawn. UNDUE INFLUENCE ALLEGED. By Telegraph—Press Association. Wellington, Last Night After a long conference between counsel for the parties a settlement was arranged to-day in the Glover estate will case in which probate was opposed oh the grounds that undue influence had been used, the defendants informed the Court that no further evidence would be called and the Chief Justice said that on the case as it stood he was prepared to pronounce for validity of the will and two codicils propounded by the executors. Judgment was entered accordingly and the terms of the settlement other than the pronouncing of the validity of the will and codicils were made a rule of Court. After announcing the terms Mr. Watson said that pursuant to the settlement the defendants (Mrs. Dunn and Mrs. Cowles) withdrew all the, allegations made against Mrs. Galbraith. The Chief Justice said he saw no reason why he should, not pronounce in favour of the will and codicils. It would have been impossible to find there had been any undue influence. He thought it his duty to say the charges against Mrs. Galbraith had very properly been withdrawn. Dealing with the question of testamentary capacity his Honour said the letters written by the testator during the crucial period appeared to him to be dona fide letters, and on the evidence that had been adduced he felt he would not be justified in drawing any other conclusion.
