The hearing of the suit brought by “Wizard” Smith against Smith’s Weekly for £20,000 for alleged libel was continued to-day. Ludwig Nudi, who accompanied Smith to Ninety-Mile Beach as ignition expert, was cross-examined about the reasons for a violent estrangement between himself and Smith. He replied: “I had criticised a reporter for sending a wrong report concerning the state of the beach to the New Zealand Herald. I told him it was a deliberate lie to say the beaeh was bumpy and full of shells and washouts when it was in perfect condition. The reporter answered that it had nothing to do with him as Smith signed the telegram.” Mr. Holman, K.C., counsel for the defence, claimed that the real reason for the estrang»ment was due to Smith’s giving certain instructions after seeing articles this witness furnished to the New Zealand Press.

Donald Harkness, designer of Smith’s car, gave evidence that the car had a gear ratio sufficiently high to break the then record of 245 miles an hour.
