JUDGMENT FOR DEBTS

CLAIMS MADE AT NEW PLYMOUTH

Judgment by default was given by Air. R. W. Tate, S,M., on the following debt claims at New Plymouth yesterday: —Taranaki Herald Co. v. Reginald James Poole, £3l ISe (costs £fi 7s fid); Roberts Ladder Co. v. C. Guy, 18s (12s); A. Pearce v. P. Mills, £7 13s (£1 12s fid); IL C. Moss v. Timi Water, £2 4s nd (£l. 16s 6d); same v. Jimmy Putu, £1 5s 7d (£1 Is).

Under judgment summons J. G. Boulton was ordered to pay May and Sons Ltd. £4 7s 3d forthwith, in default fpur days’ imprisonment; George P. Wareing was ordered to pay H. G. J. Webb £23 Ils and £1 Us 6d costs forthwith, in default 14 days’ imprisonment, the warrant to be suspended during the payment of 10s a month; W. J. Reynolds was ordered to pay .Mrs. B. Harris £ll 16s fid and costs £1 Is forthwith, in default 12 days’ imprisonment, the warrant to be suspended during the payment of £1 a month. After hearing the defence the magistrate gave judgment for Mrs. E. 0. Connett on her claim for £35 10s, being a balance owing for board and lodging by Riiawhiti Ilikanui, otherwise known as William O’Carroll. Costs allowed amounted to £6 Bs.

The case for the plaintiff was that o‘Carroll had lived with the Connetts from September 12, 1930, till May 11, 1931, having been introduced there by Mrs. Sofl’e, Mrs. Connett’s niece. The rate agreed upon was 25s a week, but all. he had paid was £7. In August he asked for his account; this was made out for £35 10s, a sum that was not disputed by him, and he. handed the account to his solicitor.

The defence was that the rate agreed upon was 10s a week, not 255, and that the amount due had been paid in several sums. From September to March 0 O’Carroll, it was submitted, had earned £-13 15s 7d from the Producers’ Freezing Works, of which Connett was foreman; he gave the amount' owing to Mrs. Connett every time he received his ln addition to this sum he was in receipt of moneys from the Native Trust Office. No receipts were given for the amounts paid, and he never asked for any. It was maintained that some of the payments were made to Airs. Sofl’e, while she was looking after the house when Mrs. Connett was in Wanganui.
