Hamilton, July 22.

The action of a police constable in questioning a man after he had been arrested was commented upon ny Mr. Wyvern Wilson, S.M., in the Hamilton Magistrate’s Court to-day.

Tho constable was giving evidence in connection with a charge preferred against a man of having been intoxicated while in charge of a motor-car. Witness said that while ho was searching accused he asked him if he had had an accident.

The magistrate remarked: “You had a right to search him, but why did you question him after he had been arrested? I do not like it.”

The information against the accused was dismissed.
