MOTOR APPEAL DISMISSED
OLD COLLISION AT MANAIA. After hearing argument Mr. Justice Recxl on Saturday dismissed an appeal arising out. of a motox - collision at Manaia on July 24, 1927 and allowed the respondents £7 7s costs. The collision occurred at the intersection of the Main South and Lower Normati'by Roads and as a result James John Patterson claimed £229 14s 6d damages from Catherine and Harry Sutton before Mr. R. W. Tate, S.M., at Manaia. Mrs. Sutton, who drove out of the side road, was being taught to drive at the time, and was to have been tested for the issue of. a licence the next day. On February 27, 1931, the Magistrate gave judgment in favour of the defendants, holding that both parties wex’e negligent and that both contributed to the cause of the collision; therefore neither’ could recover.
The appeal was against this decision. Mr. P. O'Dea appeared for Patterson, the appellant, and Mr. John Houston for the respondents.
