Charged with breaking and entering warehouse of Ellison and Duncan Ltd., Port Ahuriri, on the night of July 25 and stealing cash, cheques, .postal notes and other articles to a total yalue of £ll5 16s 7d Allan Arthur Mclntosh was found not guilty in the. Supreme Court before Mr. Justice Blair to-day. For the defence Mr. C. W; Nash produced witnesses to prove that Mclntosh left the shop where he was employed: at 9 o’clock in the evening, to a friend’s place where he stayed until » o’clock the following moriijng. Mclntosh’s mother gave evidence to the effect that she heard her son re-, turn home shortly before 4 o clock. For the prosecution Mr. H. B. Lusk stated that Mclntosh’s nfibi wa S llofc complete because various witnesses were not quite positive of the times of the accused’s movements and that the diN , ference of half an hour would be suf« fioieni for him to have perpetrated the crime.
