SALE OF MOTOR LAUNCH
BUYER CLAIMS EQUIPMENT. OWNERSHIP IN DISPUTE. The ownership of a dinghy, a set of tools and other articles concerned in the sale of a launch was in question in a civil claim'heard in the New Plymouth Magistrate’s Court before Mr. R. W. Tat°e, S.M., yesterday. A -fisherman, Frederick ’Warne, claimed from Thomas Reid, with whom Clifford Oakes was joined as defendant, £l7 12s. Cd., of which £l2 12s. Cd. was stated to be the value of. the dinghy and launch accessories. The principal defendant, Reid, who was stated to be ill at his home at Oakura, did not attend, and Mr. P. Grey, acting on his behalf, could not open his defence. . , Mr. C. H. Croker (for Warne) stated that as the result of a newspaper advertisement Warne and a friend, William Grocott, had gone to Opunake to buy the launch and equipment. A price of £5O was decided upon and the launch, dinghy and equipment were delivered at New Plymouth early in August. On October 18, when Warne was ill, it was alleged that Reid and Oakes had gone to the plaintiff’s beach cottage and removed the articles claimed for.
Details of the transaction were given, The history of the purchase, delivery and defendants’ recovery of certain articles was outlined by Warne. Grocott was to have assisted him in a fishing venture. William Grocott and Andrew Coffey then gave evidence relating to the claim, and Ronald Greiner, Mr. Croker’s office, gave additional evidence concerning the financial side of the transaction. On Mr. Grey’s application Mr. Tate adjourned the hearing to next Wednesday. If Reid was still ill he would have to‘establish that fact, stated the magistrate. ®
