BREACH OF RIGHT HAND RULE.
On being charged at the New Plymouth Court yesterday with failing to give w l ay to a motor-car on the right when driving along Devon Street at the Dawson Street intersection on September 13, Mrs. Minnie Violet Mac Diarmid pleaded not guilty. Mr. C. H. Croker appeared for her. ifrs. H. B. Mace, Puiiiho, said, she was driv.’-g down Dawson Street towards tha sea to the Devon Street intersection at a speed of 12 to 15 miles an hour. When she had turned the corner into Devon Street a collision took place with a car proceeding towards the town. Her car was struck on- the front left side. There was no obstruction to cause trouble. '
Mr. Croker asked for a dismissal on the grounds that the collision took place on Mrs. Mace’s left-hand side. He submitted there was evidence to prove that if the vehicles had continued on their course there would have been no collision. The collision occurred because. Mrs. Mace turned not because the cars continued on their courses. The question of who came first on to the intersectio i did not affect the case. The bench remarked that it was obvious Mrs. Mac Diarmid had had the last opportunity of avoiding the accident. On behalf of his client Mr. Croker then pleaded guilty and a fine of 10s (costs 30 s) was imposed.
