He believed that had the machine for which lie' Wds hgerit bceil a satisfactory one the business would have been a success. Baiikiupt resided in llaWera and advanced sums to Natives in tlie hope of getting' their land biisiness. He sustained Heavy lOSsbs, He invested over £4OO iii tlie Hawera Miiiefal Water Co. TreWeek prOiliided to pay ihini £25 if he would guarantee his bank accotifit. Bankrupt Hid so, arid had to pay the bank £358 ih consequence. Ho attributed his insolvency chiefly tb thb fact that without any previous business experience oi- training lie engaged oil his oWii docotiht in a business which lie How knew demanded technical and business knowledge, rind to the fact that he spent considerable capital aild incurred liability for largo stints, endeavouring to develop air agericy for a typewriting iuacliiiie Which tiirririd oiit a disappointment. He Could nbt say definitely what amount was yet to conie ftoih his father’s Cdtate as lie liad never had any statement from the trustees, lie did ilbt tliihk it would bo ovOr-estitiiat-iiig tlie nioitCy yet to coiiie if the hmount was>shown as £loob. itepiyiiig to Mr. Sage Howlands stated that his only investments had been the tobaCfcd Company and mineral water Company. BILL OF SALE TRANSACTIONS;

Mr. North questioned (bankrupt on transactions in connection with Treweek’s furniture. Bankrupt admitted that he had transferred the bill of sale he had on the furniture to Mr. Aloutie. Later, when Mr. A. H. Playle had intended to seize the furniture for rent owing by the Treweeks bankrupt had given an undertaking to pay certain sums tb prevent that action. The furniture had later been sold by auction and an order bad been given Halliwell, Thomson. Horner and North on’ behalf of Mr. Playle for the rent owing. Rowlands denied that he had any dishonest intention in giving the undertaking and order. Whatever your intentions may have been we were not paid, were we?—Not so far as I know.

Mr. North asked why a sum of £24, for which Morison, Smith and Morison, Wellington had obtained judgment was not shown in the list of creditors. Rowlands replied that judgment had been obtained about two years agb and the matter had been overlooked. Over the Ihst 12 months. bankrupt said, he had discussed his position with Mr. Mourie. Hb had not wholly disclosed his position aiid had not discussed the larger liabilities. As far as bankrupt knew ME Motirie was prepared to give him financial assistance. Mr. S. Alaealistfer (Stratford) stated that on Jul.y 4 a distress warrant haff beeh returned nulla holla. - Oil August 20 bankrupt hiitl given Mt. Mourife collateral security in the shape of an assignment over his interest in his father's estate. In 1920 bankrupt's account had been guaranteed for £501) by Mr. Mourie aiid in December of the saine year £3OO had been advanced. Another advance of £l5O, which had iiot been fully made, liad also been arranged, partly a charge on the English estate. The point he Was making was that both tlib latter charges oh the English estate had been made after the execution of the distress Warraii t.

The bank had the first charge on this English estate, Rowlhndb said in reply lb Air. Macalistef. Air. Mourie had a bill of sale over 'the steel office furniture. The steel furniture had been part of the stock in triltle. When lie had arranged for the advance of £l5O Air. Mourie knew he had debts lie could not pay. Mr. Motirie, as far as bankrupt Was aWare, knew that the interest in the English estate was the sole asset. Tne arrangement with H. L. Young Ltd. had not been that he should sell the typewriters on that firm's behalf. He bought the machines from tlie firm. He had been paid for all the maehinfes he had sold.

To Air. North Rowlands said that the undertaking to Halliwell, Thompson, Horner and North about the Treweek bill of sale had not been authorised by Air. Mourie, who had, however, been told of it. Bankrupt had been acting to protect Air. Alourie’s bill of sale and the latter had not disapproved of his actions. He had not expected to make any profits in the first few years out of the typewriting business.

Tlie meeting was adjourned peiidihg further investigations to be inade by the roA
