OVERDUE PROMISSORY NOTE
JUDGMENT GIVEN BY COURT.

Wellington, August 27. An action to recover £950, allegedly overdue under promissory notes, was brought in the Supreme Court before the Chief Justice against the executors of the late Anthony Harper, bootmaker, Wellington, by a firm of merchants alleging that Harper had promised to pay£looo and had not done so, except £5O. The defence was mainly that the promissory notes were given, for. an illegal consideration; i.e.,‘ an agreement not to prosecute a former secretary, a friend of Harper, who, it was alleged, had admitted various defalcations to the company. His Honour gave judgment for the full amount, with 50 guineas costs and disbursements, saying that it had been made clear to the secretary at the outset that it was never intended, to prosecute.
