CLAIM AGAINST STEPSON
ACTION RE-HEARD AT HAWERA. A rehearing was granted 11. J Sommers, farmer,-of Little Waihi Road, in the Hawera Magistrate’s Court yesterday on a claim decided in favour of his step-father, A. Simons, farmer, of Inaha, in the absence of the defendant, Sommers, at the previous sitting of the Court. The grounds of the plea for rehearing were that a misunderstanding had arisen concerning the time at which the adjourned presentation of the action was to take place. Possession of a cow, three years of age and valued at £l2, was claimed by plaintiff, who alleged that the beast had been removed from his farm by defendant, who had subsequently refused to return it. Plaintiff also claimed £7O, said to be the amount of a loan made to defendant on April 1, 1930. The previous judgment in favour of plaintiff was affirmed by the Magistrate, Mr. J. H. Salmon, S.M., the return of the cow or its value, £l2, and the £7O claimed with costs £9 ss, ordered. Plaintiff was represented by Mr. P. O’Dea, Mr. L. A. Taylor appeared for defendant.
