PLAINTIFF AWARDED £223.

DEFENDANT’S SPEED EXCESSIVE

Reserved judgment for £223 2s 9d—£173 2s 9d special damages and £5O general damages—was given by Mr. R. W. Tate, S.M., at the Eltham Court yesterday in a claim by Frederick David Hall against Bertram Walter Briggs.

The magistrate said plaintiff came down Hunter Road toward the intersection on Eltham Road at a speed of 12 to 15 miles an hour. He saw no traffic and heard no horn. When he reached the intersection he saw a car coming up Eltham Road about a chain and a-half away, and he proceeded on without any sense of danger, believing that he had ample time to cross. When nearly across, the rear part of his car was struck by the other car at a point four feet north-west of the centre of the intersection —on defendant’s wrong side.

- “Defendant’s explanation as to how he got there is unsatisfactory,” continued the magistrate. “1 am satisfied his speed was excessive. The plaintiff 'being committed to the intersection when defendant was a chain and a-half away, the defendant continued on at an excessive speed with the plaintiff in full view in the act of crossing, and defendant did not use his brakes until within 18 feet of the point of impact. The plaintiff had the defendant on his right and was under obligation to give way to traffic on his right, and I am invited to find that he was negligent in that he did not do so. Under the circumstances I do not think he was negligent but, assuming that he was, the defendant had ample time and opportunity to avoid the accident by a reduction of his speed and by travelling on his correct side after the plaintiff came into view. In my opinion the collision was entirely attributable to the negligence of defendant.” Security of appeal was fixed at £lO 10s and the payment of costs amounting to £l5 13s. ' HUIROA NEWS. EUCHRE PARTY IN AID OF SCHOOL. - (From Our Own Correspondent.) A euchre party and dance in aid of the school funds was held in the Huiroa school room on Friday evening, July 12. The function was a sweeping suecees, about fifty sitting down to euchre. The winners were: Ladies, Mrs. Fred. Mitchell; men, Mr. W. H. Wallace. Booby prizes went to Miss Greta Ford and Mr. M. Wallace. The prizes were presented by Mr. H. R. Wickham, chairman of the school committee. After supper some 20 couples indulged in dancing, music being supplied by Mrs. Jack Reid. Extras were played by Miss Phyllis Stanford, Mis. Price and Miss Violet Wallace. Mr. Bob Murphy was M.C. The school committee intends to hold parties every fortnight through the slack season, to donate a points prize for competition. Mrs. R. D. Milne, of Brooks Road, Stratford, has been the guest of Mrs. H. R. Wickham. The Education Board carpenters have been employed at the school during the past week renovating the building where required. Mr. and Mrs. lan Grierson and Mr. and Mrs. AV. J. Reid, formerly of Stratford, are now residing in the district. Mr. B. Wiggins’ horse fell under him and broke its leg while he was riding to .the station on Saturday. The animal had to be destroyed. Mr. and Mrs. H. Hoby and family are at present spending a "holiday in* New Plymouth. ADJOURNMENT OF HEARING. MAGISTRATE REFUSES BAIL. Four youths, whose names were suppressed, were charged at Eltham Court yesterday with a series of thefts. After hearing the evidence of three side-show proprietors, who had stalls at the Hawera winter show, regarding the identity of the articles produced, the Magistrate, Mr. R. W. Tate, adjourned the cases, on the application of Detective Meiklejohn, till Tuesday next. Netta Pell, Beaumont Richmond and Walter F. Toogood said that none of the articles produced had been given as prizes from the stalls *they conducted. Detective Meiklejohn opposed Mr. A. Chrys tai's application for bail on behalf of two of the youths, but £5O bail was renewed on behalf of one of the others. The fourth youth was not held in custody. Replying to Mr. Chrystal’s plea for bail the Magistrate said he would not grant bail before the next hearing.

CHARGES IN ELTHAM COURT. F, H. Scown, for failing to attend the annual military camp at Waverley, was fined 20s (costs 12s) at the Eltham Court yesterday. Defendant thought that as he was living outside the “effective” area he had no need to apply for exemption. Margaret McDonald, .for riding a bicycle without a light, was fined 5s (costs 10s) at the Eltham Court yesterday. For a similar offence Alan Thomas Blair was fined 10s (costs £1 Os Cd). James Mancer, who rode a bicycle on the streets of Eltham without a bell, was fined 10s (costs 20s 6d) at the Eltham Court yesterday. George Schneider, who drove a car across an intersection at Conway Road, Eltham, at 11 p.m. on July 3 was considerably surprised when interviewed a few minutes later by the borough inspector and charged with failing to give way to a vehicle approaching from the right. The vehicle happened to be driven by the inspector, who told the Magistrate at the Eltham Court yesterday that defendant had cut right across the intersection at an acceleraed pace.
