JUDGMENT IN Civil. CASES. The monthly sitting of the Magistrate a Court was held at Opunake yesterday, Mr. R. W., Tate, S.M., presiding. In. the following undefended.- civil cases judgment was given for plaintiff by default with costs: E. F. Loesch v. E. Nbrthcott, £l4 0s Id' (costs £2. l-ls); El. J. Manty v. C. Maiiriri; £'» 3e 3d ( £2 3s 6d)S-. Norcross v. Sarali Marrriri. £56 5s 5d ( £5 0s Gdj; Hugksccr-s, Ltd. w. W. Holtaia, £1 5s- (13s); A. P. Newport v. J. G. Williamson, £-19 19s. Ild (£-1 6s 6d). In. a judgment summons case, there being no appearance of judgment debtor, C. M. Hill was ordered, to pay Hughsen’s, Ltd.' £4 Ids Id forthwith, in default four days’ imprisonment.

In the- case adjouimed from last court day in which- Hughson’s, Ltd. claimed. £9B 7s Id on a judgment summons from Allen Robertson, T. P. Hughson junr. gave evidence that the credit had been given largely on the understanding that the debtor had a milking machine for sale and would pay plaintiff from the: proceeds. The judgment debtor offered to pay s'e per week. The* magistrate declined- to make an order as it had not been established that the debtor had had sufficient funds since the summons was issued, but he made it clear that if fraud were established. the question of means became of minor importance.

BREACH OF MOTOR REGULATION

J. H. Wooler, who did not appear but submitted a plea of guilty, was charged with a. breach, of the motor regulations by approaching the intersection of the Main South and Kahui roads at Raliotu at a speed exceeding 15 miles an hour on March 30.

Constable Brenchiy stated that defendant had driven past the intersection,, a busy one, at a speed of between 30 and 35 miles an hour. Defendant was fined 20s„ with costs IDs. The magistrate remarked that it • was the first case in the district and that the fines would be increased, if tho offences continued. REGISTRATION OF DOGS. A native named Fred Eiria was charged, on the information of the Egmont ■ county inspector, with having kept four dogs- of a greater age than six months for more than fourteen days without causing them to Be registered. Asked how he pleaded, Euia said one ’ dog. a greyhound, "not belong to me; it belong to Ngaliuia. One is a pup not yet nine months. The other two belong to my father, and not to me. I only keep one dog; it too hard on the cows, so I give it away.” To the magistrate plaintiff said lie milked cows, hut the farm ’ belonged, to his mother, aged 100, and his father, aged 85. Ills father liked to keep the jipgs"to chase the cows out of the garden.’ “He got to register, not me,” added , defendant.

The magistrate pointed out that defendant could not have unregistered dogs about the premises. If they did not belong to hrm he must either send them away or get the owners to register them. He therefore adjourned the case for a month to give defendant an opportunity to either ge l rid of the dogs or have them registered.

NOXIOUS WEEDS NEGLECTED

Fred Euia was also charged, on the information of Air; F. W. Sutton, noxious: weeds inspector, with failing to clear ragwort from his property. He pleaded guilty, remarking that there “was ragwort on the farm all right. I start to clear it last January, before I get the notice, but- I been, not too well —blood poison in the shoulder.” He add-, ed that usually the milking took six hours and Be had two hours daily for ragwort cutting,, but since he had not Been able to use his shoulder lie had been unable to cut ragwort. Defendant was convicted and ordered to pay costs 17 s.
