MISSING WITNESS.

INCIDENT AT HAMILTON. COMMENT BY THE JUDGE. FORFEITURE OF BOND ORDERED. Hamilton, June 9. An unusual contretemps occurred in the Hamilton Supreme Court to-day owing to the non-appearance of an important witness in a ease in which a young man was charged with forgery. "This is a nice state of affairs,” remarked Mr. Justice Herdman, when the repeated calling of witness’ name proved fruitless. * "It is the business of the police to see that witnesses arc here, and I want some explanation as to why this witness is not present. The witness will forfeit his bond if he does not appear and give some reasonable explanation of his absence.” The judge would not agree to accused being asked if the witness’ depositions in the lower court were correct. After some delay the case was adjourned until to-morrow morning. The missing witness v. is ordered to forfeit his recognisance of £5O. Mr. T. H. Gillies, the Crown Solicitor, stated afterwards, that a witness had not previously failed to appear in the Hamilton Supreme Court during the last 16 years.
