CLAIM DISMISSED By Telegraph.—Press Association. Auckland, Sept. 17. A hazards “school” figured prominently in a claim for £4O fis brought by W. P. Burman t motor mechanic, against W. R. Robinson, horse dealer, before Mr. W R. McKeen, S-M. The claim was repudiated as a gambling debt. Plaintiff said that he had j>aken over from a man named Simons, in June, four cheques, each for £lO. These had been given to Simons by defendant, and were dishonoured. Dave Simons deposed that he met defendant in a gambling school, when the latter was not having the best of luck. Witness cashed four £lO cheques for him, and later he paid the cheques to plaintiff, who knew nothing of the origin of the cheques, and was not at the school. Defendant deposed that on the night he gave Simons the cheques he had lost about £7O. He bet with Simons for £2 and £3 on a throw of the dice. These were higher stakes than he was in the habit of playing for. When the amount he was losing at the time was less than £4O he received the difference in cash. Witness was certain plaintiff was at the school that evening, there being between 20 and 30 persons present. Simons called at witness’ plaee next day and said the bank would not pay out on the cheques, as his account was overdrawn. He lost to both Simons and plaintiff that evening, and subsequently decided not to meet the cheques. I The claim was dismissed.
