The Supreme Court sittings were continued to-day before Justice Cooper. Ernest Larcomb, architoct, claimed £265 from Henry Coles for the preparation of .plans and supervision of a building His Honor gave judgment for plaintiff for £2O without costs. Thos. Rodgers, land agent, claimed £243 from Samuel Greer for commission on sale of property to R. E. Bannister. The case was one in which ono land agent gave particulars of the property to a client, who afterwards purchased the same property through another land agent, who also had instructions to sell. Evidence was given by Thos. Rodgers (plaintiff), Claude Mitchell (clerk), Samuel Greer (defondant owner of property) and R. E. Bannister (purchaser of the same). His Honor gave judgment for defendant with costs. Thos. Clark claimed from the North Island Brewery Company, of Mangatainoka, a dividend alleged to have been declared last year. The statement of defence denied the declaration of a dividend, which had been subject to a a proviso that the shareholders resolve to issue themselves some of the snares now unissued, and to devote the whole dividend to the amount due in respect of the shares. At the annual meeting plaintiff and another shareholder refused to take their dividend except in money, and the proviso was never passed. His Honor said that plaintiff had been misled into bolieving a dividend had been J declared and had not known of the proviso until the statement of defence was put in. He therefore allowed plaintiff ! to take a non-suit, and only allowed costs at five guineas.
