HILL V. HILL.

_ Thoma* W. H. Hill, of Blackball, petitioned for a divorce from his. wife Alice Hilh .of Kelson, on the ground of adultery with Daniel Burke, of Wellington, labourer, who was joined as co-respondent. Mr E. B. Moore appeared for the petitioner.

The evidence showed that the parties were married -on November 30th, 1910. After their honeymoon they returned to Nelson, artd lived at Haven road, where the- petitioner had provided a, house, for. one week. They then moved to his wife's mother's place, where they stayed for three months, mttil she ordered him out of the house. The petitioner wont to ,tho Railway Boardinghouse, and wrote to his wife asking her to join him there until he could provide another, home for her. On July :-i4th,_ 1911, the .petitioner went to To Kuiti. and again wrote to his wife, but she did not reply. Ho then went to Auckland, where he stayed for over three yeays. • Whilo there ho heard that his wife had given birth to a child in .Wellington. lie had not cohabited with her since one* month after their marriage.

Hume, of Wellington, stated that .some time last March the respondent came to her house, and a.sk<xi her if she would let her room ; «. :She said that sho came from Nelson;, and that her husband was waiting outside-. She explained that they were "pretty hard up." and that he was going to live at his sister's, but there, was no room for iior. While sho was there the respoi dent's "husband," a thick-set, dark young man not tho petitioner, used to corao and see her of an evening. After sho had been with her a week, Mrs Hill gave birth to a child.

His Honour granted a decreo nisi, with cost,s ngainst the co-respondent, and expenses, tlio decreo to he made absolute in three months.
