The High Court dismissed the appeal in the Bernasconi case. Judge Murray, of Papua, stated a special case on several grounds, the main point being as to whether Bernasconi had the right to claim trial by jury.

The Chief Justice said that the section of the Constitution providing for trial by jury related only to offeuu-.s created by Parliament and ly statutes passed in execution of its functions and described as the laws of the Commonwealth. The request for a jury wais, therefore, rightly refused.

Mr Justice Isaacs and Mr Justice Rich concurred.
