CLAIM. FOR RESCISSION OF CONTRACT.
In the case of Elijah Burin-v. Josephino Alma Olga Ten-ill, a oiaim for rescission of contract for the sale of 7 acles of land at Murcuison, Mr. A. T. Maginnity appeared-for the plaintiff. Mr. E. h. Moore said lie had, been instructed -by Messrs. Findlav and Dalziel, of Wellington, not to ofi'er any objection to ther.ciaim. r , His Honour, ordered, that the contract for the saje of the land bo rescinded; that the land bo-'reconveyed to the plaintiff j that the defendant be prevented from further dealing with the property; that if the land has been mortgaged, the amount, of the mortgage to be ascertained, and defendant to find the sum necessary, to redeem the mortgage j that defendant bo ordered to pay all costs in connection with the proceedings^ including all interlocutory costs, such -costs to be ascertained by the Registrar.
