W. KING V.
ADMINISTRATOR OF
ESTATE OF R. FRY,
Judgmont in this case was delivered by Mr Evans, S.M., yesterday. Mr Maginnity appeared for plaintiff and Mr Hurley J'ol- defendant. The Magistrate held that under tho particular section of the Destitute Persons Act, under which the complaint was laid, the plaintiff was entitled to an order, and ho did not think, it came within his function to consider whether or not the ultimate result of the winding up of the estate of the deceased defendant would be sufficient to meet the order, but that was a matter for the complainant. He would order the payment of the sum of £100, and counsel's fee £5 ss.
• On the application of Mr Harley, consented to by Mr Magiunity, the order was ultimately made for the sum of £25, tho parties having agreed to this sum irrespective of the value of deceased's estate.
