In the nautical inquiry regarding tho capsize of the cutter Kiwi, Mr. Kettle, S.M., said that the Court was of opinion that the cutter capsiacd brcause she was overloaded abov<? tho water-line, but until regulations were issued dealing with this class of vessel the Court could do nothing more than say that the accident had been caused by excess of deck cargo. The damage done was not sufficient to allow the Court to deail with the master's certificate, but aa ho was responsible'for overloading, he. was ordered to pay the oostß of th© inquiry.
