i'esfcerday, before Mr H. Eyre Kenny, S, M., the following cases were dealt with :— Thomas Cawthorn versus Norman J.j Levien,|Ja claim for £78 15s. Mr E. B. Moore appeared for plaintiff, who obtained judgment for amount claimed wtih £3 9a 4d costs. J. D. Clancy versus Hakaeaia Te Whenu— a claim for £13 14s. Mr Haye3 appeared for plaintiff, who recovered the amount, with l£2 Os 6d costs. William Fitzgerald versus Daniel Fitzgerald— a claim for JBS, of which £2 10s was paid after the issue of the summons. Mr Machell appeared for the plaintiff, who obtained judgment for £2 10a, with £1 fia costs. Pitt and Mooro versus John At* kin, a claim for £9 9a Bd. Judgment for plaintiffs, who were represented by Mr E^B, Moore, .with £l|sg 6d costs. „ Kingdon. Glasgow and Hayes versus G. |W.|Boyd, a claim for £5 12s 6d. Judgment for plaintiffs, for whom Mr Hayes appeared, with £1 3s Gd. John Orsman versus John B. Parkerj a claim for £6 lls. Mr 0. Richmond Fell for plain tiff, and Mr E, B. Moore for defendant. . The Beach said in this oase ther§ was a plea of Statute of Limitation 1 set up, and that should be first disposed of. Mr Fell put in. a letter from defendant to plaintiff, in which the writer expressed surprise at receiving the summons, seeing that he had £7 8s 7d against Orsman which had not been settled, and it was understood that his indebtedness to Orsman was to go to settle what Orsman tiwed him* , Mr Foil contended by that letter Parker acknowledged he owed the amourit claimed by Ord* man. The Benoh : He 'does nothing of the kind. He distinctly says he does not owe Orsman anything. That it was agreed that one account was to square the other. Mr Moore said that after the long lapse of time Parker had lost his books, and all he could do was ta plead Statute of Limitation. The Bench gave judgment for defendant, with £1 ia costs.
