Accident Insurance.

Napier, July 9

A cj.se of considerable importance as affecting accident insurance was before the Magistrate this morning. Dr De Lisla sued the N. Z. Accident Insurance Company for £93 under one ofsthe company's policies as compensation for twelve weeks' total and fourteen weeks' partial disablement through an accident. For the defenc* it was argued that under the condiiiona of the policy action should have been brought within six months after the date of the accident. Plaintiff's counsel argued that the clause. was ultra vires because a person might be so seriously injured as not to be able to estimate a claim within six months. He further urged that the Company waived its right by continuing its negotiations after six months bad expired. Judgment was reserved.
