SUPREME COURT
SITTINGS IN BANCO,
FRIDAY, 4th December.
SALE FOR NON-PAYMENT OF RATES,
Judgment was this day given in the matter of Section 20, Town of Pieton. i'lis Honor said that the papers in the case appeared to be complete with one single exception, which was that it was not averred that the judgment in the Resident Magistrate's Court was obtained prior to the registration of the memorial, although, no doubt, such was the case. He should not delay the order on tlu3 account; but as the proceedings in these cases might po33ibly some day be strictly examined, it was for the benefit of all parties that all the requirements of the Act chould be proved to have been complied with. An order would be made for the sale of the land in question by auction at Picton, on the terms of Section 4. of the Act, upon an affidavit being filed of the date of the judgment in the Resident Magistrate's Court. The precise terms of the order could be settled in Chambers.
Mr. Pitt appeared for the Board of Works.
