NELSON BOARD OF WORKS. -[VTOTICE is hereby given, that the folJL>( lowing amended BY-LAW lias been agreed to by the BOARD OF WORKS, and has been submitted to his Honor the Superintendent and his Executive Council for confirmation.. By-Law, No. 5. _ Whereas it is expedient to make further provision for the abatement of the nuisance and danger caused by tho present growth of Furze or Gorse, &c, throughout the City of Nelson : Be it Ordered and Directed'by the Board oi? Works for the said city, with the sanction of his Honor the Superintendent and his Executivo Council, as follows, viz.:—■ ■ 1. Tho occupier, or in case thero shall be no oecup'ter, then the owner of any land upon which a gorse or other hedge shall be growing, adjoiu-. ing any public street or road, shall, so soon as the portion of tho said street or road adjoining his said land shall be clear, thenceforward keep the same at all times clear of gorse or other obstructions which it may reasonably bo supposed have proceeded from tho said hedge: and in case such occupier or owner, as the case may be, shall refuse or neglect to clear such road or street, after receiving seven days' notice to do so from the Board of Works, he shall bo liable to a penalty of not exceeding 405., and to a further penalty of not exceeding 20s. per week, for every week lie neglects or refuses to comply u,;ith the order contained in tho said notice. 2. Whenever gorse or any other inflammable plants shall be growing upon any land, in such thickness, height or quantity, as to bo a nuisance to tho public, or dangerous to any near or adjoining private property, the Board of Works may give the occupier or owner of such land seven daya' notice to clear away or trim such gorse or other plants in such manner aa may be divected by tho said Board : and in case the said occupier or owner shall fail to comply with tho said notice, lie shall bo liable to a penalty of not excoeding 405.," and to a further penalty of not exceeding 20s per week, for every week such gorso rcmaius uncleared or untrimined. 3. Whenever any gorse is growing upon unoccupied land, and tho owner of the land is absent from tho Province, it shall be lawful for the Board of Works to cause such gorso to be trimmed or cleared, as they may direct, and tho expense of so dohig may bo recovered at any future time, Avithin six years, from the owner or occupier of such land, in a summary manner, before any Eesident Magistrate or two Justices of the Peace.
