Farmers’ Union (Auckland province) on the liability for damage done to stock through the destruction of boundary fences running alongside railway lines; through fires caused by sparks from railway engines. Several members quoted instances where cattle had been killed on the railway lines after passing through damaged fences. Some farmers were faced with the problem of maintaining several miles of fencing. In the discussion it was apparent that,the position in regard to the department’s liability was extremely obscure. It was decided to accede to the request of the Northern Wairoa sub-province that if legal proceedings were taken by the Department in that sub-province in the future, the executive would conduct a test case.
