ILLEGAL LIQUOR

IN PROCLAIMED AREA. KAWHIA RESIDENT PROSECUTED. Trafficking in liquor in a proclaimed area was the basis of several prosecutions by Sergeant S. G. Clist at the Te Awamutu sitting of the Magistrate’s Court on Thursday, and a former resident of Kawhia and neighbourhood was the defendant. Mr W. H. Freeman was the presiding magistrate. Emanuel Mackado was charged with keeping liquor for sale in a proclaimed area on Monday, May 20th, at Kawhia, and also on Monday, May 27th, at the same place. Mackado was also charged with supplying liquor to a native, Haki Ponui, on May 20th, and to another native, Patangi Davis, on Monday, May 13th. Other charges were that Mackado unlawfully sold liquor in a proclaimed area, and that on May 13th he sold liquor illegally to Richard Austin and Patangi Davis. Sergeaint Clist, prosecuting, said Constable McKenzie stopped Mackado on his way to Kawhia on May 27th, and Mackado said he had some liquor with him for one Richard Austin. Austin later denied having ordered that liquor. Respecting the alleged offence on May 20th, Mackado asked a half-caste named Motu to sell liquor for him. Motu refused. On May 20th Haki actually purchased a bottle of whisky from Mackado for £l. On May 13th Mackado sold a five gallon keg of beer to Austin, and on the same date he sold a bottle of whisky to Patangi Davis for £l. The sergeant added that there had been difficulty in serving the summonses on Mackado until a fortnight ago. There was nothing otherwise known against him. Mackado pleaded ignorance of the liquor laws. Remarking that the Court costs were fairly heavy he would take that fact into consideration when imposing a fine. jr*' Sergeant Clist said if stated earlier that he was going to plead guilty several witnesses would not have been brought considerable distances. He then itemised the witnesses’ expenses.

His Worship said the costs totalled £l2 2s 7d, so a fine of £lO would meet the case. Time was allowed in which to pay.

Accepting a suggestion from the sergeant, the magistrate ordered Mackado to report regularly to the nearest police station until the liability is liquidated.
