MOTOR-CYCLISTS APPEAL

OLD MAN INJURED IN ACCIDENT A Thames motor-cyclist, Reginald Thomas Brown, appealed to Mr. Justice Ostler in the Supreme Court today to quasli his conviction by a magistrate for dangerous riding. The appeal arose out of Brown's conviction for dangerous riding of a motor-cycle on the Thames-Paeroa road on October 25 last year, when James McArerne was seriously injured. Brown was fined £5 Is and his licence was cancelled for 12 months from February 5, 1930. The appeal was taken in the form of a rehearing. Air. Garland appeared for the appellant and Air. Meredith for respondent. The victim of the accident, a whitehaired old man, with portion of one leg amputated, hobbled forward on crutches, and had to be lifted by a constable into the jury-box from which he gave evidence. Describing himself as a labourer, AlcArerne, Kopu, said he was taking one of his usual evening walks and was on his way home when the accident occurred. He saw a faint light just before the machine struck him and remarked “For ’God’s sake are you going to kill us." He was admitted to hospital with crushed ribs, and a broken leg which subsequently had to be amputated. For the appellant. Air. Garland contended that the injured man had an equal chance of avoiding the accident with the appellant. Appellant, in evidence, said that rounding the corner near the Kopu Hotel he speeded up. and then saw a cyclist ahead, but could not remember anything further. He had no reason for crossing to his wrong side of the road at that junction, and his headlight was in good order. ( Proceeding.)
