PETROL TAX REFUND
FISHERMAN’S ILLEGAL CLAIM (Special to THE SUN) THAMES, Tuesday. Said to be only the second case of its kind in New Zealand, a charge was made against Hugh Farrelly, a fisherman, in the Police Court today of wrongfully claiming a refund of petrol tax as provided by the Motor Spirits Taxations Act. Sergeant Rowell said the defendant, who owned a fishing launch, was entitled to a refund of the tax of 4d a gallon on benzine used in his occupation as a fisherman. He had omitted to apply for the refund in respect of 32 gallons of spirit made in the last quarter of 1928, but included the amount in the refund applied for in the first quarter of this year. “I would not go so far as to say that the man was actuated by dishonest motives,” said Sergeant Rowell, “but he was making a claim to Which he was not entitled.” The Magistrate, Mr. F. W. Platts: Apparently he was entitled to the Ss involved if he had made his claim at the proper time. Sergeant Rowell: That is so. He practically told the post office officials that he knew he was doing wrong, but was going to give it a trial. Defendant was fined 10s. An application for suppression of his name was refused.
