DEATH ENDS DISPUTE
HEAVY CLAIM DISMISSED
The death of the principal witness led to a «£ 6,000 civil action, which has been pending for 12 months, being dismissed from the Supreme Court today by Mr. Justice Herdman. Thomas Birch ancl Walter Birch, settlers, of Whangaruru, proceeded against Henry Geo. Foster, William E. Telfer, Geo. Reed Harrison and Rowland Hill Harrison, timber merchants, of Whangarei, for £6,000, for the value of timber allegedly wrongfully removed from a property they liacl acquired in 1926.
Applying on behalf of defendants’ for judgment dismissing the action, Mr. Meredith stated the suit had been commenced in August, last year, and had not been set down for hearing by the plaintiffs, but by defendants. Twice the case had not been able to proceed to trial. Plaintiffs were relying on a witness who had since died. The application was granted, with costs.
